Tier 2 General Extension - RLMT, SOC Code change and more

Post by macpatty » Thu Mar 03, 2016 11:08 am

Hi All,

I have been in UK since last 6 years,

1) Tier 4 Dependent
2) Tier 1 General (Main Applicant) - 14/06/2011 - 14/06/2013
3) Tier 2 General (Main Applicant) - 14/06/2013 - 14/06/2016

As you can see I will be completing my 5 years this June and wants to apply for my ILR but can't apply one because I have some tax issues for my initial tier 1 general visa where the person did my Tier 1 general did not pay any tax to HMRC. so I was wondering that I am going to extend my Tier 2 general visa in June.

Initial Tier 2 general visa was granted based on

1) A Rated Employer assigned COS
2) English test not needed as I was on Tier 1 general and switched to Tier 2 general
3) conducted RLMT test
4) job code 2137 - web developer in SOC list (can't seem to find if it was in SOL list in 2013)

Now for extending I have following questions
1) same employer, same SOC code (2137), is RLMT required?
2) same employer, diff COS code which is SOL now,(2136), is RLMT required?
3) is English test required?
4) how to show 5 years experience for that code? in my current company, I have 4 years of exp + in India, I have 3 years of exp..

Also, about IHS,
1) is IHS payable for 1 year basis or 3 years
2) do IHS applicable to my dependents? ,if so do I have to pay for my wife and 3-year-old daughter as well?

About ILR
1) if I get my Tier 2 extension this time and if I go ahead to apply for my ILR in July, 2018. will UKVI ask/investigate for my initial Tier 1 application and related tax issues. as I believe they will only ask for last 5 years which in my case will be only Tier 2 records.

your answers will be appreciated.

Note It is the applicant (not your 'advisor') who is responsible for all applications and who will have to answer for any 'issues', discrepancies, oversights & etc.

Non-payment of tax that is due cannot be swept under the carpet. It won't just go away.

What efforts have you made to regularise your tax liabilities to this country?

@noajthan: you are correct that it is my responsibility regarding tax. I have contacted HMRC regarding this and going to make payments to HMRC. but as is said, I am going to go for Tier 2 extension for now because i do not want to take any chances..

if you could please clarify my tier 2 related questions that would be great.
