EC Refused...Is there Link between New EC & Refused EC

Hi All,

My EC has been refused based on 135A(i)(ii), 320 (11) HC 395. I was in UK on student VISA when I received HSMP approval. Since I did not complete my degree, I had to go back to my home country to get EC.

It looks they have refused EC based on:

1. I did not submit my educational documents from UK
2. They noticed my part-time job from bank statements of my UK account. I was doing this job on student VISA but I did not provide any evidence of that while applying for EC.

I have given right to appeal but not sure on what basis they will consider my application.

My question is: -

1. If I apply NEW EC, with all missing documents and do not appeal. Will this NEW EC application will be treated independently?

2. British Embassy did not return my origianl approval letter. Can I apply with Photostate of that?

Hi,

1. You can reapply with Supporting Documents.

2. Also when you reapplying you can use photostat of HSMP Approval
Letter.


But point is now you where working on Student Visa and that is problematic. How you will prove that those transction of salary is not for you. Coz whenever you reapply you need to cover all the grounds for last rejection.

I am attaching 3 months bank statement to get EC this time. These 3 months will show only one occassion when I received income in my account.

I am planning to explain about my Part-Time job in covering letter. I feel I don't have options.

Do any one had same experience? Or anyone on student VISA, doing job got EC?
