PBS Dependent allowed to Enter UK ?

Q1

I’m a Tier 2 Main Applicant
First Visa – 7 May 2013 – 17 May 2016
Dependent Visa – 7 May 2013 – 17 May 2016

New Situation: Main Applicant Change of Employment
Second Visa – 7 JDec 2015 – 15 Dec 2018
Dependent Visa – 7 May 2013 – 17 May 2016

PBS Dependent has valid leave to remain under old visa(valid till 17 May 2016)
But not Main Applicant situation has changed under same category


Will PBS dependent allowed to enter UK ? under old visa(valid till 17 May 2016)

Ans : Yes / No

Q2 Maintenance fund £630 ? Indian Bank statements can be used ?
Ans : Yes /No


30 Oct 2015 Company notified UKBA that employee left the job , No curtail letter received till now. Main applicant extended to new visa under same category. Will that affect PBS dependent entry. Actual plan to extend PBS dependent visa as incountry application

sorry guys ! if you feel questions are silly , as things keep changing , just wanna make sure things are right as visa fees are so expensive now-a-days

If they haven't issued any curtailment notice, then dependant should be able to return before leave expires. Else, the curtailment is in error.

Dependent visa remains valid as long as the main applicant holds a Tier 2 visa.
You have now transferred employer and hold a valid Tier 2 visa. Sorted.

The Dependent visa would only have been curtailed if you had been curtailed. This has not happened so all is well

Thanks a lot Vinny and Frontier Mole .

I'm just wondering. Say like my partner boarded in flight and Im receiving curtailment same day. So no way I can stop her

In such Case , Curtailment will not affect Main Applicant (as already in new valid visa)
But will the dependent refused to enter UK at airport??? , just because their visa is old one though valid (17 May 2016)

Question :-
In simple if curtailment letter issued , will dependent refused to enter UK ?

She may be refused entry, unless she can convince the Immigration Officer that the curtailment was issued in error, contrary to both rules and policy.

The curtailment process has to examine the current immigration status of the individual. If as in your case you have received a new grant of leave the curtailment action stops at that point. Your new visa superceds the old one and by virtue cancels it in law.

Curtailment process is manual and is dealt with on a case at a time basis. There is no super integrated PBS computer that generates a curtailment once an employer notifies HO of an early termination of employment :D

Entry into the UK should not be a problem for your dependent. A nice touch would be for her to have a copy of your new BRP for her return journey, if anything gets questioned.
