Dear Experts,

I am starting a new thread and hoping to receive some valuable information from the seniors.

I'm currently on T2 G, my visa is expiring in 5 weeks. Unfortunately my sponsor is currently suspended due to the recent visit by UKV&I. I understand that whilst the company is under suspension an employer cannot assign a new CoS regardless if it's for an existing or a new employee.

What am I supposed to do now ? Do I just file my extension application with a covering letter from my company stating that they still require my services & they wish to issue me a new CoS once the suspension is lifted. Will they hold my application till the decision on my company ? Or do I just file Flr Fp to buy three months as my ilr is due in July 16 on 10 years basis. I am extremely stressed and don't know what option to choose as I don't want them to invalidate my application without a valid CoS.

Please shed some light, your help will be sincerely appreciated.

I hope your sponsor lisence gets reinstated.

I know someone in similar situation. There application is neither approved and neither pending.

Home office mentioned them they will not offer a decision before they decide on sponsor lisence and they gave option to candidate to either withdraw application which he has not availed.

If i am you, i will still put an application and meanwhile keep looking for other jobs.

One thing i assure you from my experience, they most probably wont reject it but from my expeirence they also wont grant it quickly, It will be a slow application but if that doesnt stops you from working, then i will say that dont get so worried.

Thank you for your reply.

Would you know your friends timeline? Do u mind sharing if possible ? I want to establish how long does the ukvi takes for a complicated application as normal extension application takes a month.

I will probably file an extension application. I have been looking already for another job however, no joy yet.

Slow application is fine I guess as my ilr is due in July 16. It will be ideal to wait till July and then vary my application. What u say ?

No problem. I appreciate your concern.

In his case, his application is pending from 7 months. He wrote them once and they said if he want he can withdraw.

He obviously doesnt want to do that because then what will happen is, he will recieve a curtailment letter as he cannot extend.

However because that time will still be count as legitimate time on tier 2 as he has an active application with UKBA, he has not withdrawn it and it is still pending a decision.

However he is still working and is also looking for other jobs.

Till the time they dont make a decision on his employer lisence(Which is currently suspended NOT revoked) they wont make a decision on his applicaiton.

This is sort of linked.

Also if i am you in the worst scenarion(High Unlikely) if they refuse(which they shouldnt)

You should file an FLRO and mention that you want to extend and have a sponsor whose lisenced is nOT revoked and only suspended and you will like to wait before a decision on his lisence is made as it is interlinked to your application.

FLRO will borrow you some more time and that tile will count in your ILR.

Getting a sponsor lisence suspended is very frustrating. I know

Thanks for you input so far.

Don't you think FLR FP is the best option in this regard, I have recently come across some cases where UKV&I returned the FLR O and advised the applicants to file the FLR FP. In fact this was also mentioned here by some users on this forum.

Please share your thoughts ...
