Student Visa

Excuse my ignorance but I know nothing about immigration and visas etc.
Have read lots of info, but really need direction/advice.

My son's fiance is studying for a PHD and she has applied for an extention to her visa, this will be the second time I think. They have lived together for over a year and are engaged, they want to marry in the future. Her visa runs out the end of this month, if it is not extended what should she do, again if it is extended what should she do with regard to marrying in the future as there appear to be several options.

Is there any reason it might be refused?

There are lots of options, depending on when and where they want to marry.

Many thanks for your prompt response. My sons fiance has been "informed" by a fellow student that because it has already been extended there is a possibility her visa may not be extended because she could finish writing up in her home country.

They want a traditional wedding in a church and don't want to have to marry "quickly" unless absolutely necessary. That is where I am confused about the different visas fiance, spouse etc

Ah, people's 'friends' always seem to be immigration experts!

If she can justify the extension, then there is no reason it will be refused. If it is, then the easiest thing will be for her to return home and apply to re-enter on a fiancee visa, which will give them six months to marry. Or, if they want to marry in her country, they can do so and then apply for a spousal visa.

I wouldn't worry about any of this yet though. Wait and see what happens with the student visa.

Once again many thanks for your prompt response, I agree, so many immigration "experts" have come out of the woodwork giving her 10 different answers.

When we know whether or not the student visa has been extended, maybe we will need more advice from you.
