Can I go on holidays ?

Post by alimista15 » Wed Mar 23, 2016 7:23 am

Hi,

I have 7 weeks of annual holidays left and I want to take another 4 weeks parental holidays (which are unpaid). So total of 11 weeks.

Can I take these holidays to go to India ?

If yes then do I need to do anything like reporting it to HO, or checking if my salary PA will stay inline my visa requirements,

Do i need to worry about anything ? I am on Tier 2 General.

Thanks in advance

I understand that but can I go by myself for this long ?

reading 26.19 from here
https://www.gov.uk/government/uploads/s ... dendum.pdf

26.19 The only other exceptions to this rule are:
a) where the reduction is due to the migrant taking a period of:
 maternity leave
 paternity leave
 shared parental leave
 adoption leave
 long-term sick leave in excess of one continuous calendar month

Does this include this,
https://www.gov.uk/parental-leave/overview

Please respond, thanks

Did you check with your HR team? They may have knowledge about such things or at least they could find out from UKVI or even you could give UKVI contact centre a call.

But as long as it's annual leave and parental leave (which is genuine need for a parent) I guess rules would be in favour of such things. Do you meet the eligibility criteria https://www.gov.uk/parental-leave/eligibility ?

Also, your organisation might have paternity leave option as well which is generally paid leave and it's generally 2 to 4+ weeks I believe..so explore that option as well.

Sorry, I can't quote any necessary rules from UKVI without doing some research.
My advice is based on personal research/experience, so pls check relevant UKVI sources.
