They always send the passport back after they have made a decision (approve or refuse). They only withhold the documents when they have reasons to suspect them being dodgy. One possible explaination might be that the documents are lost in transit.

This is not true what u write about passport. Op put this question because his visa is still valid for 20 days, they refused him and didn't send back his passport.

Ho never sent your passport back when your visa is refused and previous one expired at the time of decision. They keep it with them because its easy for them to remove the person when passport is in their hand.

I am have submitted the Administrative Review Today. I have explain the situation to UKVI.

I will update if there is any reply

Update on 01.06.2015.

I have received the refund on my administrative review back in to my Bank account. I believe they accepted my Administrative review and refunded today. I have not received any letter yet and I believe they will send me letter soon.

As follow to my last post. I did my administrative review and the fees was refunded. However, I received IS96 Detainment letter today from UKVI. Asking me to Report on 15th and then every 3rd Monday, means every month. I have contacted with solicitor. He is told me to go and report on 15th on Monday and they have filed PAP (Pre Action protocol). I believe they made a wrong decision. I already have pending file with UKBA of FLR LR and they refused my TIER 4 and then they invalided my Administrative review. Then I received IS96. However. They mentioned on the letter of Administrative rejected and they are aware that they have my pending application with UKVI of FLR LR.

Please advise Needed.

Temporary Admission and FLR (LR)

Hello I need advise on my Student visa and FLR(LR)

On 25th Applied for Tier for Visa which was refused on 17th MARCH 2015 and refusal letter received on 9th MAY 2015 with Administrative review. Administrative review was made and refused as invalid.
On 8th July they send me Temporary admission liable to detail and ask me to report every month.
On 27th MARCH I applied for FLR (LR) and asked home office to VARY my leave from Student visa to FLR (LR) which they did not. Appeal received. I appeal and wait for hearing date.

Questions:
Q1: Why they serve me IS96 because when they refused my Tier 4 on 17th march and sent me letter on 9th may. However my FLR(LR) application was pending from 27th MARCH.
Q2: My Appeal is pending on FLR LR that mean I am lawful in the country and on the other hand I have IS96 that I am liable to detail. So what is my status.
Q3: While Temporary admission is served and leave later granted WHICH MEAN IT CAN BE GRANTED ON ANY TYPE OF VISA.
Q4: What are my chances to win the case in the court.
Q5: Should I withdraw case and make a new application for FLR LR?

Note: FLR was refused because I did not completed the 10 years. However, I am now completed 10 years and 7 months in the UK.
