my partner is here on a visitors visa we want to get married.

Is it best for him to go home and apply for a fiance visa and then once in the uk after married apply for spouse visa or can it all be done whilst he is here now??

if he has to go home to do this is there an amount of time he must spend out of the ountry beofre he can apply to come back as a fiance

You can get married in the UK, however, Your spouse cannot switch from a visitors visa to that of a spouse. The application for the spouse visa or fiancee visa will have to be applied for in the hom,e country.
