Eligibility to apply for naturalisation.

Post by rajasam » Tue Mar 22, 2016 1:57 pm

My wife and I were students in the UK who eventually left the UK and settled down in Sri Lanka. Following this we have been visitors to the UK too. However in the year 2009 (September) we had to flee SL and we arrived in the UK and claimed asylum at the airport which was our port of entry(on our own passports with previously granted valid visiting visas). Our application was initially turned down after an interview in Oct 2009 but was granted in Jan 2010 following a hearing which took place in November 2009.
We were granted ILR in May last year and we hope to apply to be naturalised this May (We have a son who has been registered as a British citizen). My question is, if we have breached any immigration laws as I'm quite unsure of this and if anything prevents us from applying. Apart from this we have no other issue with the 'good character requirement'. Any advice will be much appreciated. Thank you in advance.

Thank you.
My question here is..
Will entering the UK with own valid passports and valid visas and claiming asylum at the first contact which is the immigration desk at the airport be counted as breaking immigration laws?

Hi. If you claimed asylum on entry, you were not in breach of immigration rules. This applies even if you had entered illegally without a visa. You must also have been compliant throughout, for example continuing to sign as required.
If you use the nationality checking service at a local authority, they can check that the Home Office consider you to have been in breach before sending your application.
The Refused are coming day-by-day nearer to freedom.

I believe that the NCS will advise not before Jan 2020.
