My Friend Was Refused A Visitors Visa Recently

I invited a good friend to visit me and my family for the Christmas period. I have not seen him for a few years and was prepared to pay his air fare, accommodation and finances.

He sent his application form to the Embassy in Jamacia, they turned down his application based on the the fact that the information recieved from his empolyer was not the same as that he had presented on his form.

The mistake however was actually down to his employers.

When the Officer who was dealing with his claim telephoned his employers to enquire about the date he started work they stated the wrong date even though he had the correct date on the application. What they had failed to recognise was that there were two offices but both held different information on their records.

They called the office with the incorrect information and my friend was turned down on that basis.

The work letter also showed a wrong salary as he had presented on his form (he changed the salary on the work letter manually to show his true salary).

The refusal letter also stated that they did not believe that my friend would have returned to his country at the end of his visit.
The Officer stated in the letter, that his personal opinion was that there was nothing within the English law stopping me from visiting him in Jamacia.

My friend does not have a criminal record. He has worked all of his life, he has two children who depend on him.

I wanted him to have a 4 weeks holiday over the Christmas Season as it coincided with my holiday.

What the immigratition Officer failed to realise is that not all Jamacians want to come and stay in this Country.

He now has 28 days to appeal under two catergories, humanitarian or facial.

I am now going to try and get him to come for a holiday during the Easter
Holidays.

Any help/advice would be apprecitated.

VV's from JA are rarely granted - two third rejected, not easy task u have.

Can you give the EXACT wording of the refusal?
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

I am not satisfied that your application meets all the requirements of paragragh 41 of the Immigration rules because,

You state that you work as a ........ earning $80,000 per month you have produced no satisfactory evidence of your savings, income or assets in Jamacia and no satisfactory evidence of of your financial circumstances and commitments.

You have produced a letter from your employers stating the above salary, however having noted that you adjusted the details on your application form and that you had few savings, I undertook some checks with the head of your employer, an HR manager at the head office confirmed that you had only been there since March 2002 and not January 1998.

I was then able to speak to the accounts department who states that the head office is responsible for all salary payments and that your salary was in fact only half of what you claimed on your letter.

I am therefore not satisfied as to the authenticity of the details contained within your employment letter and I am not satisfied of your circumstances nor that you have purposely conveyed a false impression of your employment to boost your chances of getting a visa.

I am therefore not satisfied that your intentions are as you have stated And I am not satisfied that you are genuinely seeking entry as a visitor for a limited period or that you intend to leave the UK upon completion of your visit 4(1)(ii).

In reaching my decision I have also taken account of the Human Rights Act, whilst I accept that this decision constitutes limited interferance with article 8, I remind myself that this is a qualified right, and I am satisfied that the decision is justified and proportionate in the intersts of maintaing an effective Immigration Control.
I am also ware of the fact that there nothing in English Law that prohibits your sponser from travelling to Jamacia and enjoying family life with you in this country.

What advice do you want for? The new application of the appeal?
For the appeal, its over, you or he already screwed it up and there is no way you will win the appeal based on the facts you presented, especially on facial or humanitarian groups. So forget it.

I dont intend to give up without a fight. Why can't my very good friend be allowed to visit me in my country?.

Because he got a pal at his workplace to give him a letter saying that he had worked there since 1998 and earned $80k/month. In the absence of any corroboration, the ECO took the very reasonable step of phoning the HR department and the accounts department who confirmed that he's lying.
Sorry, but that's what it looks like, and unless he can come up with some proof that he's telling the truth, he can forget any appeal, and another application would be a waste of money.
He could start by producing bank statements showing the monthly income he claims - but then if he had these, he could have included them with the application, couldn't he?

The contributors on this forum may be busy. You come across as expecting and wanting quite a few things from BIA.

Please state the plain facts in a succint way and if somebody can help, then they will.
