ILR refusal - please help with appeal points

ILR application on the basis of 10 years continuous residence was refused in Sep 2015 due to a conditional discharge received in March 2015. 2 years need to pass for this not to create grounds for refusal.

I was automatically given the right of appeal based on human rights claim and entered my appeal in Sep 2015. I understand I will end up waiting for a year or even more.

I was not considered for limited leave to remain. If this appeal is heard before 2 years since conviction have lapsed, how can I please argue so I am allowed to stay / granted ILR?

Please help me.
