Baby born in the uk

Post by Brasileiro » Thu Apr 07, 2016 12:15 am

Hello guys
I hope you can help me please
I am Brazilian living in London with ILR since 2011
I and my partner (no Married) have a one year old boy born in london, now my partner doesn't have legal status for now in the uk,.. Is illegal

Do I need to apply Mn1 form or can apply passport for my boy?
If I can apply the passport now as I have ILR before he was born will his mum status affect it? Will they ask her papers?

Thank you

Hello!
Thank you for.your answer
If a DNA confirmation is needed, should I send it along with application or wait till they ask for it?

Probably okay, if you are named as child's father on child's birth certificate and child was born in UK between 1 July 2006 and 10 September 2015.

Did you click on Vinny's 15 September 2015 (blue) link and then on the 'changes' link in the thread it takes you to?

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

There is one awkward question about your child's mother's status. Is she married? If she were married, the child's British citizenship would have to derive not from you, but from her husband.
