Tier-2 General Change of Employer

Hi,

I am currently in UK from last 3 years on Tier 2 general VISA which has recently renewed for another 3 years. I am looking for change of employer and have following queries:

1. Change of employer with the current job title, the employer has to issue the new CoS or before doing so the advert process has to be completed.

2. After the CoS has been issued,Do I need to apply for a new Tier 2 VISA application. If so, after completing total 5 years in UK(already completed 3) will I be able to apply for the permanent leave in UK on the existing VISA or have to spend another 5 years as new VISA was issued.

3. Change of employer with a different job title, Does my employer has to follow the entire advert process of 3 months in order to issue the CoS?

1. RLMT (advert, etc.) needs to be done before issuing the CoS.
2.Yes you need to apply for new Tier 2 application. After completing another 2 years, you should be able to apply for ILR.
3. RLMT is for 28 days (not 3 months) so they can issue CoS after that, i.e. you are a suitable candidate and the employer can prove that RLMT was carried out properly.
My advice is based on personal research/experience, so pls check relevant UKVI sources.
