Spouse Visa Guidance for ILR

Post by ahmadcambridge » Mon Apr 18, 2016 7:35 pm

Currently I am on spouse dependent visa and my husband has British Passport. My indefinite leave to remain is due in two years on the basis on long residency route (10 years route) and I still can stay 300 days out of UK because in last 8 years I was out of UK for 200 days. I have few queries.

1) For how long I can stay continuously out of UK. It is 120 days or 180 days.
2) For how long I can stay maximum number of days out of UK in each year and in particular in the last year (10th year).
3) Can I take two exits of 120 days or 180 days out of UK in one year?
4) How many days I should stay in the UK between two exits. For example if I take two exits of 120 days or 180 days.
5) Is there any possibility in near future home office will change rules in long residency route?
6) If I get ILR for how long I can stay out of UK without having any implication for Naturalization. It is one year or two year or three year.
7) Though we married in 2012 in August but I switched to spouse visa in 2015 as I was doing PhD. Is there any possibility my previous year can be counted so I may get ILR soon.

Since "ahmadcambridge" is already a BC, you must be the spouse! Please state so when asking queries.

1. 180 days in a single absence,
2. 540 days in 10 years. No per year restriction.
3. Read 1 and 2.
4. Read 1 and 2.
5. Ask a clairvoyant.
6. Assuming you remain married to your British Passport holder spouse at the time of becoming eligible for naturalisation, 270 days in the 3 years preceding the application and 90 days in the 12 months immediately preceding the application.
7. No.
Life isn't fair, but you can be!
