ILR eligibility after marriage

Post by VashiS » Wed Apr 20, 2016 7:02 pm

Hi,
I've got married to a UK Citizen and hence wish to enquire about my ILR and citizenship eligibility post wedding. I got married last month (Mar 2016) and my Husband is a UK Citizen since Feb 2016.
I have been in the UK on different Visa categories for almost 6 years now and wondering if I am eligible for an ILR on the basis of the time I have spent in this country and now that I am married to a UK Citizen.

Could you please let me know what my eligibility for ILR and UK Citizenship is please?

Some background on my previous Visa categories:
From July 2010 - July 2013 : Tier 2 Intra Company Transfer Visa
From July 2013 - till date : Tier 2 General (Sponsored) Visa

Hoping to get some advice.
If you need any more details from me, please do let me know.

Thanks
Vashi

No citizenship without ILR.
ILR after spending 5 years in UK as a Tier 2 migrant migrant, excluding time spent as Tier 2 ICT migrant if entry clearance as ICT migrant was applied for after 05-Apr-10.
Assuming you are married to a British citizen on the day you are granted ILR, you may be eligible for naturalisation (BC) from that day onwards.

Thanks for your response.

So I have two more years before I can get my ILR.

Couple more questions please?
1) Can I switch my visa category to become my Husband's dependent (not sure what the dependent visa is called) and still count my time on Tier 2 General (that is last 3 years) towards ILR?
or would switching visa category start my 5 year clock again?

2) Secondly please advice the fastest route that gets me the ILR at the earliest and also gives me the freedom to switch jobs without sponsorship visa?

Hope you can help

Thanks
Vashi

1. No. Changing to FLR(M) will reset your ILR clock, so ILR only in or after 2021.
2. PBS ILR as Tier 2 (General) migrant in 2018.
