hi i am illegal in uk since 1999 .I got married in 2003 and have a 2 year old daughter.My country is pakistan anyway.
But problem is my wife a uk citizen keep changing the jobs cause of her drink and w**d habbits which is affecting our family life and especially my daughter life.I love my daughter.
I cant go to my country if i do go i will end up losing my child which i dont want .She wont be any help. We are living together but we fight like a cat and dog everyday.
I need your help people what would you do if you was in my situation.
Any help will be appreciated please

What attempts, if any, have you made to regularise your stay in the UK. Or are you totally unknown to the authorities?

You can report her to child protective agency and in the meanwhile try to regularize your status

i did try to regularize my status in 2001 i claimed asylum and all the appeals got exhausted in 2002 . And now i am a failed asylum seeker.
But telling child protection agency is losing my daughter cause HO dont care about that anyway.They have a white only immigration policy.

No, it is not about losing your daughter it is about protection your daughter which means you are just thinking about yourself
You are illegal, That is one issue
the other issue is your abusive alcoholic wife. If she is not fit to take care of your daughter then you have to report her. Whether it helps your immigration status is not the point. You will have to come up with another way to regularize your status or you are just using your wife's problem to help your immigration issue as you have put up with if for 5 years.

saj234, I think it might be possible for you to apply for residency as the parent of a British Citizen (your daughter), but I'm not 100% about the rules for this, and I think it is usually for parents who are estranged/not together. I'll let someone else explain, but you should most certainly try to do something for your daughter now before it gets worse.

Obviously you want a way to stay in the UK with your child...have you sought any legal advice yet?

Everyone seems to be missing the obvious way to regularise your stay: you are married to a British citizen, so why not obtain a spouse visa!

No matter what you do, you will have to leave the UK and return to your home country in order to apply for a visa for the UK. An application for a visa as the spouse of a British citizen seems the easiest and most logical way for you to obtain permission to live in the UK. If you can you should start preparing such an application, return to Pakistan and apply for a spouse visa from your nearest British embassy.

Dawie, dogs usually might not let cats apply for spouse visa! I think the OP is looking for an alternative route.

For the sake of his daughter he might want to think about staying with wife for the purposes of regularising his stay in the UK. It will be by far the best, if not the only, option he has.

Only as long as the wife supports the application as well. No way to do so without her support which, I suspect, could well be the case here.
