what is medical evidence in EU1

hello everybody ,

could you please tell me what is medical evidence in EU1 application form , i received a letter from DOJ that they required my medical evidence ??? tried to contact DOJ but nobody picked phone :(
i am non EU national ,already applied EU1 .


anybody can help me ? i ll be thankfuL

Proof of Medical insurance for you and your spouse.

Not really...that's something that should be challenged at the E.U level or the local courts.

Is your EU family member working in Ireland, or are you self sufficient, or are they a student?

You do not need to have medical insurance if they are working.

sage as u asked .... yeah my wife Eu national is working full time AS manager
in accounts .but i came as student 3 years ago ,still holding a student visa .in regarding medical evidence what u rec what i have to do .?

Your wife is working so I know of no law requiring you to have medical insurance. Did they write you a seperate letter requesting you provide evidence of medical insurance? What exactly did they say?

The law does not require proof of medical insurance...unfortunately, the law and practice are far different in Ireland. It would help your case if you provide proof of medical insurance.

If I were applying for EU1 and my spouse was working, I would simply put the following answer to the question.
My spouse is an EU citizen who is exercising EU treaty rights by working in Ireland. Because my spouse is working, there is no requirement in either EU law or in Irish law for me to have medical insurance. For Irish law see specifically European Communities (Free Movement of Persons) (No. 2) Regulations 2006 - S.I. No. 656 of 2006 - Residence in the State - Section 6 (2) a and 6 (2) b. You can confirm this with the legal affairs coordinator of the Treaty Rights section of DOJ.

I know of no legal requirement that I show proof of medical insurance as a requirement for the EU1 application to go ahead. I would therefore request that proceed immediately with processing the application that that it can be issued within the legally required 6 months.

Good point Directive.
I personally did not submit medical insurance.
Medical insurance is only needed if/when EU citizen is student or retired person.

Students and retired people may reside in another Member State only if they have sufficient financial resources and health insurance to ensure that they will not be a burden on the social security system in the host Member State.

Just left it blank.
My wife and I both work so I did not think it was needed.
Mind you, my wife had a twice stamp 4 previously(one year at the time),before all this fiasco with EU1.
I never submited in the past so it did not make a sense to do it now.
Its just another crapy rule they think they can get away with :evil:
