Tier 2 extension

Hello Manci,

I am planning to switch to tier 2 general from ict.my fitr entry was in 2010 March.got two extension in uk.my current Cos code is 2136.hence my future employer says RLMT not required.Pls confirm on this.my ILR is due my this Sept due to gaps.

Extracted from current shortage occupation list. The RLMT exemption is very narrow and the roles that qualify are solely these roles. If other activity is carried out then the RLMT exemption does not apply.

Currently I m in 2136 code, does it impact my switch to general if future employer using same code with same role since he is not doing RLMT.And salary would be 36k.

If the role does not strictly meet the Shortage Occupation list then it can not benefit from the RLMT exemption.
If at a later point it was found that the role did not qualify under the Shortage Occupation guidance the Sponsor may have their licence revoked. Which in turn leads to the curtailment of your leave.

Being in a SOC 2136 role currently in no way gives you a RLMT exemption. Only moving to the strictly outlined roles in the Shortage Occupation list gives that exemption.

If your new role does not fit to the Shortage Occupation list then it must have a RLMT.

You should understand SOC Code is the one against which Employer assigns the CoS and some of the SOC comes under shortage occupation list.
For example, as Frontier mentioned, following roles under SOC 2136 comes under shortage occupation list, where RLMT is not required. Are you one of them ? what's your job role ? Designation does not matter.

employer has done RLMT test .its been confirmed by checking the link.employer confirmed that they will issue the SOC 2136 with RLMT though this code falls under shortage accupation.

SOC 2136 does not have a blanket RLMT exemption as you seem to think.
Let's get this straight, the only ROLES within SOC 2136 that are exempt from RLMT are those that are listed under the shortage occupation, as I have already posted.

I note you have failed to state your actual role when asked so that would perhaps indicate you know the role you are planning to take does not qualify.

The next interesting point is that you have gone from Sponsor says no RLMT test needed for SOC to they have undertaken RLMT. And you say you have checked a link - what link?

None of the yes/no to RLMT makes any sense. Either you or the Sponsor is talking nonsense.
Good luck with going forward because if they have not done the RLMT properly then you are going to be refused and heavily out of pocket.

Hello Frontier,

I am into IT sector.my current ICT CoS states same job code 2136 which my future employer also applying same code it seems.

My future employer confirmed that they have carried out the RLMT Test process and RLMT will be applicable for me with job code 2136.

Please suggest me on this.

Take the COS from the new employer and apply for your change of employer Tier 2 visa.
Make sure the salary is at the experienced level or above.
If the RLMT is all in order and your application is fine then you will be moving jobs shortly.

CoS start date and delay in joining date to serve notice.

Hello Friends,

My new employer has issued a unrestricted (in country from ICT to TG) Cos with start date as 15th June 2016.I need to provide 2 months notice to current employer.

I am yet to file the application with given CoS.Kindly suggest to overcome this notice period issue.

Can be joining date delayed to serve my notice period ?
