Hi
I appealed my wife spouse visa refusal in May 2015 now I got a court date two days ago for July 2016. Her refusal was based on that I haven't deposited my part time job payments to my bank account.
Now my question what are our chances of winning I still work earn nearly 21 k still employed at that part time job as well deposited all the wages have the payslips p60 and employment history which shows I have been employed at full and part time jobs for last three years.
Shall I go for it alone or hire a solicitor?
Thanks.

Hello, from the information I have gathered while preparing my wife's appeal, the rules clearly state that all wages must be paid into bank account, all deposits must match corresponding wage slips, any kind of discrepancy and the visa should and will be refused, if you have not been paying your wage into the bank, you have no realistic chance of being successful in the court.

I didn't deposited the wages in first sixth month of my part time job. After that now nearly two years the employer have transferred all my monthly wages to my account.
Will the judge take into account my current situation and current payslips and documents after the the refusal or will he or she consider only the situation and documents when I made the application in January 2015?

Only the refusal reasons at the time of the original application will be discussed, you could be unemployed now, you are trying to prove the original refusal was wrong, if you did not deposit the wages prior to your application you will struggle to win the appeal

To be honest
I had no hope that I would win my appeal as my hubby was a overstayer in the UK, but Allhamdulilah i won my appeal.
I would agree that all payments need to be deposited but u may be able to fight the case on human rights etc so best bet would be to take a solicitor and all ur evidence from hmrc of what u earned in that year u was refused

My deadline has now passed and my solicitor said she will call the courts tomorrow. I was thinking of contacting my mp, in what ways do you think the mp can help me?
