Tier2 ICT Visa Extension for second time

Hi Experts,

I have a unique situation - wondering if someone can advise
I was employed to India branch of my firm and later got transferred to London office .
Below is my Visa and London trips details:

Visa – TIER 2 (INT COM TRAN) MIGRANT (Valid 11-Aug-2009 To 11-Sep-2010)
Travelled for Company work to London
> 23-Aug-2009 – 27-Sep-2009
> 17-Nov-2009 To 21-Dec-2009
> 13-Apr-2010 To 24-May-2010

Visa – TIER2 ICT LONG TERM STAFF MIGRANT (Valid 04-July-2011 To 03-Aug-2014)
Travelled for Company work to London
> 09-July-2011 To 01-Oct-2011
- Got Permanent Job offer from same company in London office and travelled on above valid visa on 14-May-2013
- Applied Leave to Remain in UK when above visa expired and got a extension (Valid 17-Aug-2016)

My Question is :- Since I came to UK on a visa that was already over by 2 years - Can I get my leave to remain extended or will I have to leave UK due to Cooling off period?

Since you came on the same ICT LT Staff visa in May-2013, it seems your employer did not cancel the visa when you moved back to your home country in Oct-2011. In that case, you will complete 5 years on your current visa in Aug-2016 and will have to return back to your home country. You will be subject to 12-month cool-off before you can apply for another Tier 2 visa (unless you are paid GBP 155,300 or more).
