Ancestry Visa Refused - Appeal Lodged

Post by metal » Thu Jan 06, 2005 5:36 am

Hi Everyone,

Recently my sister's ancestry visa application was refused.

Before that, my ancestry visa application was accepted and an AV granted.

The ECO has given my sister the right to appeal and we have lodged an appeal.

1. What are the chances of appeal getting approved?

2. Is it possible to apply for the AV visa again although her appeal is under consideration

regards

What are the grounds for refusal?

She provided the very documents that I provided. Each and every required document was provided in original. All documents are verifiable and certified.

According to the attached refusal letter:

"...these documents are relatively easily obtained in your country."

Rather short statement - the ECO is not satisified on the balance of probabilities as to the identity and relevant relationships pertaining to the AV i.e. your paperwork is forged. Somewhat surprising if you are blood relatives on both paternal and maternal lines - are you? Did you during your own AV application list your family members (common in EC applications on the sub continent)? Did it include your sister? Are you willing to undergo DNA tests? An appeal will take more than 1 year to get listed so best to re-apply with conclusive evidence of meeting the rules. As a by the by it would appear the ECO has referred the case to the Home Office in London who have verified claimed details.

Yes.

It was not asked on the form. There was no section regarding this on the forms that I completed.
Are you willing to undergo DNA tests?
Yes.

They verified the papers when I applied for an AV and a visa was granted almost two years back. I guess we will apply again.

Moreover, will it be helpful if I attach an affidavit regarding the authenticity of documents?

(At the time of application, I also attached a copy of my grandmother's British passport along with an affidavit from my grandmother. )
