Prove English Ability using Previous Grants of Leave

Post by shannon5g » Sun May 31, 2015 6:33 am

Hi everyone! I am applying from out of the country for a Tier 2 (General) visa, but I have met some problems in the English language requirement. The thing is: I was told by my future employer that I am required to take an English test to prove my English ability in the visa application because I do not meet any of the following requirements:
a) national of an English speaking country
b) holder of a degree taught in English (I was an exchange student in the UK on an non-degree program)
c) valid English test result (My past IELTs result has expired)

However, according to my research, it seems that there is another hidden way to prove the English ability, which is "Previous Grants of Leave". According to Para 160 of T2 Guidance:
160. You will be awarded 10 points for English language where you have met the English language requirement in a previous grant of leave. This will be the case if you have ever been granted leave:
as a Tier 4 (General) student where the Confirmation of Acceptance for Studies used to support your application for that grant was assigned on or after 21 April 2011.

I had a Tier 4 visa valid from Sep 2012 to Jan 2014, in which I have met the language requirement to obtain the CoA in 2012.
Do I qualify for the "previous grants of leave" way?

I am really worried and I have written several emails to my future employer but I haven't received any reply for more than a week. I am struggling whether to book the English test now and postpone 2 months to make the visa application. Please help!!

Thanks very much!!

My future employer finally repiled! And it seems that they are not sure whether this route is guaranteed.
I feel conflicted now, and it seems there isn't anyone knowing much about this here too. ;-;
Please help if you know anything!!

OMG. I am having that as a backup option as well. but it's too time consuming. I am now contacting UKVI for further instruction on this issue. WIll keep you updated if I got any news. and IELTS is changing so much recently and there are so few exam centres. I hope things will work out eventually for both of us.

My problem is not IELTS anymore. I might not be able to get a restricted COS at all due to the sudden increase in the number of applications that breached the monthly cap by a great margin. My salary is too low to compete with other people as it is a graduate scheme role.

I am in the exact same situation, but I still don't know what to put in the form for the Tier 2 application. If there are only 4 options, which one should I choose? Add the IELTS I took that granted me the Tier 4 or that I have an UK degree? How did it turn our for you? Thanks!
