British Citizen and NON-EU Spouse - EU Directive Visa 2016

Post by DandyDandy » Fri Aug 19, 2016 4:29 am

Hi guys,

I hope I am posting in the right place, if not please advise...
Let me start at the beginning of our immigration tale. :!:

Me and my husband have been living:studying/working on the UK for the past four years, back in March 2016 we were refused our Spousal visa to the UK, due to me not meeting the requirement for the £18,600 threshold (I had just graduated, just found a job just got a promotion and was well on my way to meeting it -just fell short about £800 a year, which I was aware I wouldn't meet and so we applied for FLM to be considered outside of immigration rules, based on the fact I was afraid to return to Egypt ( my husbands native country) due to the instability ect, and the UK being the centre of our life... Home, dog, jobs, sick family, still refused, and actually said a "mere preference to live In The UK is not substantial enough" subsequently we left the UK may 2016 to Egypt, leaving us both Jobless and homeless and dogless, (I've had to leave my dog with my dad for now, the single hardest thing Ive ever done)

We applied under the directive for a short stay c visa to Ireland so that I could find work there, I hve extended family there and it would be easy for me to move my home contents and of course my dogs, across from UK, submitted application to Ireland at the Alexandria consulate Egypt on the 7th June, forwarded to Abu Dhabi visa center in the middle of June, chased it up for a while ( they didn't know where it was) still can't find out how long it's going to take... It's now the 19th August... I know they are experiencing really long delays... So after reading some of your posts about it taking up to a year... They are really quite hard to talk to over the phone, I'm considering now getting my documents back from the Irish embassy so I can apply to the Netherlands for a Schengen visa for the spouse of an EU citizen, hoping that we would be able to get that quicker,

Despite the UK's terrible judgement that Egypt is fine and dandy..I need to be with my dog and my husband, i cannot live in Egypt, I cannot speak Arabic, can't find a job, get sexually harassed regularly, me and my husband were attacked on our second day here because a bloke kicked a puppy in the face and we asked him why.. Hospital admission.,, police report... I have been getting harassed by the guy ever since ( the police gave him my phone number) And even more important than that I can't bring my border collie here to this animal hell, she wouldn't cope in the heat at all.. Missing her like hell we both are...

Just to be clear I don't intend on using the suringer sigh route I just need to start our life somewhere where we can live "properly" the UK has had it with us .. I've lost everything I had thanks to them..

If anyone has any Advice on the following I'm Sure it's also useful to couples In similar situations... As I know a lot of people are stuck waiting for this Irish visa under the EU Spouse Route... And maybe need somewhere else to turn...

1. When I retrieve my documents back from the Irish embassy, can I apply to the Netherlands for the short stay type C visa for spouse of EU national whilst the Irish visa application is still pending? By this I mean (WITHOUT withdrawing the application) (I've struggled to find info on this anywhere) ? Would it pose any issues? Or should I withdraw the application to Ireland in order to apply somewhere else?

2. Also is anyone aware of any delays for applications under the EU directive for the Netherlands or any other EU county... Or is it just Ireland that's having these delays....?

3. Where is the fastest place in the Schengen Zone to apply for an EU spousal short stay visa... ? Has anyone had any experience POST Brexit, on visas from the Schengen area being issued on time?

If any one has any information on either of the three questions I'm sure myself and others would be extremely grateful

Thanks in Advance

1) Not an issue if you have all necessary docs.

2) Not reported in forum recently.

3) Delays are not Europe wide.
Dig into posts in the forum but you should get regular Schengen visa in reasonable time for most places,
