HSMP Vs Workpermit Which one is secured ?

Hello All,

I have just read aayu's post i.e

"How long can I stay in after being made redundant?".

Firt of all i felt very bad about the cruel behaviour of your director.Hope and wish u will get a better job and everything will be sorted soon.AAyu dont be depressed it will not help u.Be confident and search for another u will surely get one.

I am on WP at the moment and my company is a MNC,just couple of weeks back they sent my application for extension.But now i am not sure if i have to change my status to HSMP or stay on WP.There were no signs of layoffs or redundancies at the moment.

But still anything might happen right?

I am qualified for HSMP.Please give me suggestions if its better to be on HSMP or WP?As of now i am planning to change to hsmp if there are any sign's of layoffs etc.

HSMP unlike a WP is not employer specific and allows self employment. It also where it is the last status held at ILR application allows the amalgamation with time as a dependent in any category leading to settlement in the qualifying 4 year period which no other category does. No brainer really - HSMP is King.

Yes Kayalami u are right.

But not sure if i have to apply now itself because just couple of weeks back they send WP extension application.And i have'nt received any update about it.

(As i feel my job is secured for couple of years)
3.Say if something goes wrong and if i have to apply to HSMP all of a sudden to remain in UK what are the chances of getting approval?

Tricky not to unless you intend to rely on your employment contract as proof of your graduate level work experience/ specialist skills/ senior management experience - is this why you are afraid of going for HSMP. Are you in an umbrella type situation? Perhaps your WP status (which typically requires grad level work experience) will add some weight to a non employers letter application but don't count on it.

Its ultimatley your decision whether to apply now or later as only you know your excact status vis a vis career, immigration plans etc. Note that if you leave it later then the scheme may have changed to your advantage or disadvantage.

3.Say if something goes wrong and if i have to apply to HSMP all of a sudden to remain in UK what are the chances of getting approval?(I have 80-100 points)

You will get approval if you meet the requirements of the programme as it exists on the date of your application and you can submit the relevant proof.

Actually i am not afraid to apply for HSMP.But as my company has already applied for WP Extension.(Till 2007).I thought i can apply to HSMP after 1 year.Actually till now i dont have any problem with my employer they are good bunch.They are the ones who sponsered me and now applying for extension without even asking them.

But then somewhere i am little bit afraid about these layoffs, redundancies,outsourcing so i thought its better to change to HSMP.I feel my employer will support my application and they will provide the info i want.But i dont want to bug them as they have already sent WP Extension.So i thoght i will give a break and apply after 6months -1 year gap.

This is the reason i am confused.Now u might be clear about my situation.

Hi,

In my opinion, switching to HSMP could be a better deal, because;

1. As Kayalami very rightly pointed that in future, scheme may take a turn in any direction. At the moment it is in your favour. Future, no body knows.

2. In case of any unforeseen redundancy, you will have relatively less worries.

3. And in case of continuity of job (as you are expecting), you will straight away get HSMP extension, so it would be a win win situation.

Of course decision is yours.

Thanks a lot for yours suggestions.U r right.From yesterday i started giving serious thought about this.I will wait for the WP Extension as the application was already sent.I am planning to go to india in May so after returning back I will apply for HSMP ASAP.

NMSheik as u said it will be lot easier when i am on board to get this done.

The only advantages with WP are:

1. WP is cheaper than HSMP (in most WP applications there is no need to extend whilst HSMP status must be extended after one year= extra costs). In most occasions employers bear the costs of WP.

2. Less paperwork to do.

What I hate is: the people just pick up the kind and softhearted employee to tackle first... otherwise it won't be so easy to kick a person out a company in HALF day without any notice in advance.

What is wrong with me?! Is it legal by the way?! If I insist not to leave, how long usually it can stand for (continue working in office)?

I think it depends on your contract.If your contracts states one month notice to be given by either parties then what they have done is legal because they will be paying you one month salary.

Actually that is lot better than going to office that one month because you can search for jobs and can plan something for you.If they ask u to come to office that 1 month then u wont have time to plan.

Also if u get any job inteviews u can tell them that u are on notice period u still are employee of that company.I suggest you to tkae any experience letters and ask them for good references.The job market is better than last year i feel.If you are confident then will defnitely get better job.All the best.

I Beg to differ from you strongly. The Job market in IT is still the same. Just a little of movement here and there Otherwise if you are looking at those number of ads in the jobsites most of them are only mere ads no actualy jobs.

Regarding people who are laid off, I've known that nowadays the employer are pretty well aware of the procedure of informing the Home Office about the layoffs. Because they are pressured as per the legal rules. If they do not cooperate with the Home Office then they get a bad remarks in thier records. There was a layoff of an employee in my friends company who was on Work Permit and the Employer had informed this to the Home Office. He discovered this when he got the letter at his resident to leave UK within 28 days of notice expiry or find a new job. Otherwise he is blacklisted.

Okay i am not telling that job market is fantastic i just said that it is better than last year.From my experience i know people who got jobs(From last november) without any experience it depends on the way u search for jobs.First of all i feel people does'nt prepare well for interviews i feel a candidate should be in a position to hit and get the job atleast in the first 1 interview if not second.(Experienced).Then only they should apply for jobs.For graduates i agree it takes time to understand the process.But if the candidate has visa problems then as u said its really hard to get jobs here because no one considers yours CV as well hardly 1 in 100.

Dont tell me that people are not even getting interviews.If someone is not getting any interview for more than 3 months than they should check there CVs first.I feel bad for u'r friend.

As long as i think u'r employer should infor to HO only after one month not now.So from now u will have 2 months time.

If your contract states there is 1 months notice period.

ND, I am being harsh, just trying to put the picture right!

On job front its the agents who really bug you asking all sorts of question. 2 out of 30 are actually having jobs with them, who still hesitate to forward your CV to the client.

I totally agree with what u said.But we should understand that its all business.When we are searching for jobs the ball is in there court.From my experience if agent tells he will send your resume to client.He will defnitely send.But what happens later is.The client will sort u'r CV's again so if they does'nt sort yours then how will the agent call u.80% of the agents does'nt have knowledge about the job.What ever words the client gives in Job Spec they will search for exactly same words in u'r CV.

So for all those who are searching for jobs just make sure u have all those words in u'r CV then atleast the agent will be happy to send u'r CV.I feel even the clients are same.

According to me the difficult part is getting the interview.Now i am working in a company where i am the only india.

Back to original stuff.

Endorsing the views of Kayalami & NMSheikh, I also think that switching to HSMP is a better, rather safe bet. I did it myself and faced very little tension when I lost my job. As a matter of fact, one have nothing to loose. As said by NMSheikh, its a win win situation.

Thanks for the suggestion.When did u switch to hsmp.Actually my employer had just extended my WP till 2007 so i think it wont be good if i tell them that i want to change to HSMP so i am planning to apply after 6 months .So did u tell to u'r employer that u are switching to HSMP ? Can u tell me u'r experience ?

There is no need to tell your employer that you are switching to HSMP.
