Permanant Residence - Non-EU Family Member

Post by Leo13 » Sun Oct 30, 2016 1:53 am

Hi,

I am a non-EU family member of an EU person. My gf and I have been living together since 2009 but we applied for my 5 year residence card in 2012 which will be finished in end of 2017. We dont want to be together now as she wants to move on but she wants me to get my PR as I have worked really hard here and we are in good terms with each other. I have 2 questions:
1. What will be the requirements to apply for PR in end of next year 2017.
2. Will anything be mentioned on my PR card that the reason of getting it is family member of EU national.
3. Will I be able to bring anyone dependent on the basis of this PR from India.
Please answer these questions as they are very important for me. They mean my life to me as I have worked really hard to earn living for my family.

Thank you.
Leo

Why are you so concern about who you are according to the EU law. Family member of course.
It is really good to help and everyone deserve to be respected in life. Good luck.

As unmarried partner in a relationship akin to marriage (assuming its not just bf/gf) then you are an extended family member of your Union citizen sponsor.
If you separate before acquiring PR you will have no rights to remain and work or study in UK.

1) Read the guidance.

2) Ofcourse. If you acquire PR you cannot hide the origin and facts on which it was acquired.

3) No, don't think so.

Regarding Question 3, my understanding is that once you hold PR you would only be able to sponsor a family member under the much tougher UK Immigration Rules.

Hi Casa,

Thank you for your reply. Can you please confirm if I can move on with new relationship after PR and if I can bring my partner to UK as you mentioned family member. Awaiting your kind reply.

Thank you.

Regards,
Leo

I believe so, if you can meet all the requirements as a sponsor. This will include an annual income of at least £18,600, evidence of a genuine and subsisting relationship and adequate accommodation.

I'm assuming you intend to marry in the future and submit a spouse visa application.

However, you're a long way off from qualifying for PR and you should bear in mind noajthan's advice "If you separate before acquiring PR you will have no rights to remain and work or study in UK."
