I was a student and have since graduated since 2005.

Situation is when i graduated, i have worked under the former SEGS scheme (science and engineering grads scheme).

Just before that 1 year expired, i was employed by a company on a work permit basis.
Since then, i have been working in the company.

My question is: Will this 1 year(SEGS) that i have worked after graduation count towards the 5 year ILR?

Pls advise.

I have a similar situation, I came to UK in 2001, stayed as student till June 2005, swtiched to Segs which was valid till June 2006. Switched to work permit in June 2006, switched jobs and reobtained WP in Oct 2008. So based on 10 year ILR rule, should be able to make an application in September 2011.

However my question is that does the year for SEGS count towards ILR? because if it does then I can make the application in September 2010 based on 5 years of working in UK.

(1) If SEGS year counts towards ILR (Based on 5 years on Work Visa rule)
SEGS = Sep 2005 to June 2006
Work Permit = June 2006 to Oct 2008
Work Permit = Oct 2008 till (Sep 2010)
Make ILR application in Sep 2010


(2) If SEGS year does not count towards ILR (Based on 5 Years on Work Visa rule)
Work Permit = June 2006 to Oct 2008
Work Permit = Oct 2008 till (June 2011)
Make ILR application in June 2011

(3) Fail safe case (Based on 10 Years rule)
Student = Sep 2001 to Sep 2005
SEGS = Sep 2005 to June 2006
Work Permit = June 2006 to Oct 2008
Work Permit = Oct 2008 to Sep 2011
Make ILR application in Sep 2011


I would really appreciate if someone can clarify if (1) is valid or not? Can save me a year towards ILR if it is true. Thanks in advance.

If you're still under this WP and based on the current ruling then I guess SEGS will not be included.

Thanks for the reply Markie,

One more question. I am now in a postion to switch to Teir 1 since my salary falls in the band where I am eligible to switch to Teir 1 General. Would this make any difference? My feeling is that it will not, however I am still going to switch to Teir 1.

SEGS only counted towards 10-year and 14-year ILR, not towards the work-based (5-year) ILR. This is also the case for the IGS and the new Post-Study Work visa.
