my girlfriend is ukranian, she is currently in the UK on a 3 year student visa. she has been in the UK previous to this visa and was in fact married to a UK citizen.
after the breakdown of her marriage, while in the ukraine she commenced divorce proceedings. all of which was done within the correct procedure, documents being passed from relevant authorities in the ukraine to the foreign and commonwealth office in the UK under the hague convention.
the courts in the ukraine have since divorced them.
we have been together now for three years and plan to marry. but how and where?
we planned to marry in the ukraine this summer (two years before her visa runs out). but we're concerned about how this might affect her overseas student status. her student visa was granted on appeal, with the clearance officer who initially refused it stating that funding and the fact she was not likely to return after her course was the sticking point
on appeal the judge stated she believed we would apply in accordance with the rules if we wish to marry, which we will.
is it best to marry after her stay and apply for a spouse visa from the ukraine? does the home office have the right to revoke student status following our marriage while she is still a student here?
anyone who may know more about this than us are invited to share in your expertise and any advice would be gratefully received.
