US citizen marrying a Swiss citizen-How to live in Holland?

Post by Katie_C » Tue Feb 05, 2008 6:23 pm

Hello,
My Swiss boyfriend and I are planning to get married, and I'm wondering what the process would be if we want to live in Amsterdam. Swiss is non-EU; does that make a difference? He had the possibility of dual nationality -- his mom is Spanish -- would it be better for him to get a Spanish passport first?
Not sure how complicated this process might be. I'll need to be able to work. I'd appreciate any advice.

Swiss people can live in the EU and vis versa. He just needs to be working, studying or self sufficient. And if you are married and travelling together, you have the same rights as he does.

See Directive 2004/38/EC for the basic outlines.

.

If he can get the Spanish citizenship and you have the time for him to get it, it will certainly help in general.

But, it is not necessary. Don't delay your marriage only for that reason.

Administrator, whilst getting the Spanish citizenship might be a good thing, in its own right, the fact that Swiss citizenship is already held is sufficient for the purpose. That is, whilst Switzerland is clearly not a member of the EU, and not even a formal member of the EEA, there is an agreement between Switzerland and the EEA meaning that Swiss citizens effectively have the same movement rights in the EEA as if Switzerland was a member.

Hence the signs at airports ..... EEA/Swiss citizens ... and others.

So armed with those rights as a Swiss Citizen, being able to legally live and work in the Netherlands, surely just a question of the non-EEA/Swiss spouse applying for a permit to live there with their spouse.

The Swiss have a wonderful collection of well presented information about EU citizens coming to switzerland. I realize you want to go the other way, but the basic requirements are the same. See http://eumovement.wordpress.com/info-switzerland/
