Thanks Casa for your prompt reply. One more thing. ..The 28 days concession applies to PEO application as well or one has to apply only after completing the FULL SIX YEARS before applying for ILR?

Applies to both PSC (previously PEO) and postal.

Many thanks Casa for clarification. .As someone was suggesting here that the 28 days concession only applies to postal only applications.

Hi everyone.
Anyone who applied and been granted ILR on the basis of 6 years DL. ...Did you have to copy any particular paragraph from the HO office website as part of your covering letter?
I have in mind the "chapter 8 transitional provision " or "Asylum Policy Instruction Discretionary Leave Version 7.0 Published 18 August 2015" if the answer is yes...Which paragraph?

Sorry I missed you last question from all the excitement....You have to complete x2 3 year DLR if you are on the 6year route. If the 2nd one expires 2018, please wait till then and apply 28 days before it expires

See the case above is same as mine and he did apply for ilr before his 2nd DL expires coz h/o took 13 months to grant extension.

This is why i am confused because some people are saying as long you completed 6 yrs frm first the 1st day you your 1st DL.

Using the case above m i correct to apply in 2017 or just wait for my 2nd extension to expire in 2018.

Hi everyone.
Here is a success story of ILR after 6 years DL(non asylum case )
Initial DL granted 29th of November 2010 for three years.
Extension applied 26th November 2013. Extension granted January 2014 for three years.
Applied for ilr today(2nd November 2016) via PEO using the 28 concessionary period rule...Ilr granted.
Also those who are on six years route are exempt frombot life in the UK test and English test(when applying for ILR ).
The main point is you should count 6 years from the grant date of your first DL.

Can i just say yes you can apply by counting from the first DL you received but i am sure you do not have to count the time you waited for h/o to make a decision.

Below is someone's response from another post:
They do not count the year they took to decide your application. You have to complete the 2nd 3 year DLR.
Thats the price we have to pay for using this route, I know it's frustrating as I've had to wait more than 7 years to get mine.
I saw a girl that had hers rejected just 10mimutes after submitting her paperwork, the sad thing is, they do not refund your £2375 and you loose your money, be patient .

If you check my case ...Today my DL visa was 5 years 11 months and 3 days. Although my 2nd DL was supposed to be expired on 13th of January 2017. But I applied via window and have been Granted ILR. SO there is no confusion about it.
If someone got their ILR refused, there may be other reason for that. .

sorry about my confusion , your case is different than ours then you do not have over a yr of waiting for h/o decision on your 2nd DL so your case is straight forward.

If you have made your application in-time for extension of your DL. The time which the home office took to make a decision on the extension application counts towards your leave legally. SO if you have completed six years since your FIRST grant date....You should apply. You can confirm this with Home office on 03001232241.

Thanks Sawman , I will try to call h/o next week and I am sure for the time being I wish to hear from others who have been on the same situation as mine who applied for ILR and got refused or accepted.

I have been calling some free legal centers asking for advice but they seem not to know if its possible to apply for ILR now or i should just wait for 2018.

I am not sure if there is a law that support the 6yr route through DL including waiting time for decision.

Well. You can read Asylum Policy Instruction version 7. update August 2015. Paragraph 10 and 10.1.
THOSE WHO WERE GRANTED INITIAL DL (asylum or non asylum ) can apply for ILR on the basis of SIX YEARS CONTINUOUS DISCRETIONARY LEAVE can apply for ILR.
Do contact the HO and ask them specific question about when you can apply for ilr and tell them when you got your initial DL,when you got extension of DL and expiry date of your current DL.

I wouldn't trust the information given on the HO 'help-line'. If you call them 10 times you're likely to be given 10 different answers. :!:

Hi for those that applied for 6 years dlr, when booking the peo on the government website, did you choose the link 'all other applications' or "Remain in the UK with family - applying in the partner, family life as a partner or private life in the UK routes"??

Hi All ,

I just want to share my good news i went for my PEO appointment yesterday. My appointment was 11.am and by 1 pm i was already out of Lunar house given my indefinite leave and i am so happy. Thank you everyone here for your help and i just want to say those who have DL 6 yrs it is possible to get ILR through PEO.

They told me that i will receive my Biometric card within the next 7 days i am worried that the courier might come when i am at work. Any chance of rearranging delivery date to weekend if i miss the courier.

Be patient guys your papers will be sorted soon.

Hi All

I was not asked any questions and i only submitted my professional certificate and my cover letter.

I did not submit any bank statements or payslips.

I received my bio-metric card yesterday.

The journey is over now , just waiting to apply for citizenship after one year if i am correct.
