Getting married in US but not staying; still need a visa?

Post by Katie_C » Fri Feb 15, 2008 8:11 pm

Hi,
I am an American, and my Swiss fiance and I are thinking about having our wedding in the US, but we don't want to stay. We'll go back to Europe after the wedding. If he doesn't intend to stay, will it be ok if he doesn't have a visa (and if he doesn't stay for more than 3 months). We don't want to live here now, but might want to in the future, so we don't want to do anything that will come back to haunt us.
Thanks.

He doesn't need a visa if you don't plan to stay in the US. I married my American wife in the US a few years ago and we went straight back to the UK. He shouldn't volunteer any information about his wedding at the point of entry (when asked about purpose of visit he should answer "pleasure"). It's a good idea to bring plenty of evidence of ties to his country of residence, just in case (don't show unless asked).
