11 month long student visa application nighmare

I applied for a student visa in country in March 2007 after completing a 2 year working holiday visa. The home office have declined my application twice due to incorrectly handling my application which my law firm have appealed on both occasions. I am now still waiting for the decision 11 months down the line from when I first applied. I have just been informed that the home office are likely to decline my visa for a third time because they have recently tightened up their rules. Their issue now is that my course is a three year diploma and only becomes a degree in it's fourth year. This was not an issue for them last year and they awarded over 40 students doing the same course as I am doing with a visa. We have explained this to the home office but they insist that each case is individual. Does nayone know if I have any rights here? It seems highly unfair that they are now applying a change in rule to my case 11 months after I initially applied for the visa. I'm a South African passport holder.

What where the issues that caused the applications to be declined?

My NCC degree course is accreditated by the University of Wales. The first time the home office called the University of Wales to ask if I was a registered student which I wasn't as they are only accrediting my course and I attend Blake Hall College who run the course. On the second occasion the home office claimed that my law firm had not provided proof that my college was listed with the home office which was incorrect and my law firm sent them the paperwork yet again...

Janice, unfortunately you have no rights and yes it is very unfair and it is getting toughter.

I think to add to your problems been a South African, won't help as South Africa is now on the HO list of countrys which need very close inspection of paper work due to high amount of passport fraud comming out of South AFrica.
