Overstayer - Long Residence Query

Post by leiney » Thu Feb 21, 2008 2:28 pm

Hi everyone

I am seeking advise for a friend of mine as everyone on here was so helpful towards me and my husband during our immigration battle last year.

The person in question is a malaysian national of chinese descent. He originally came to the uk approximatly 12 years ago on a six months holiday visa. He has therefore overstayed for a considerable amount of time. He did make an application for asylum 7 years ago but this was rejected and he was issued with paperwork to leave the country wich he has not done.

He has been working during his time in the uk and was paying tax until the asylum case. Unfortunatley during this time his malaysian passport has also expired.

I would be graeful for anyones help or advise.

Regards

Leiney

Is there anything he can do?

What did the paperwork mention? What kind of form was it?

A removal notice would stop his 14-year clock.

Yes, if he has been served with one of the IS151 forms, he won't be able to apply for ILR under the 14 year long residence category.

Hi Leinny,

Can you ask him how the removal notice or paperwork was served on him?
