Tier 1 dependent and Tier 4 (child) the same time

Post by Malink » Sun Jul 02, 2017 12:49 pm

Could please help me with advice us with our unusual situation. My daughter is 14, she is Tier 1 dependent till 9.2017 (we will not extend Tier 1 due some reasons) and the same time she is Tier 4 (child) till the end 2018. When she got the visa Tier 1 dependent (3 years ago), it was stamped on visa Tier 4(child) the stamp: Leave superseded by Biometric Residence Permit. She is studying in UK school for 4 years and she needs just one year to get GSCE. She lives in another country than UK and visit to the UK to the school many times a year. Sometimes an Officer at the border looked at Tier 4 and put the stamp and sometimes they ask Biometric Residence Permit. She will have to go the UK in September and we still don't know can she use only Tier 4 (child) with the stamp Leave superseded by Biometric Residence Permit or not. Because Tier 1 valid only till September 2017. Does she need to get the new visa Tier 4 or she can use the current one.
I would greatly appreciate it if you kindly give me any information.
Anna S.
Thanks

She is not both at the same time, because that is not possible. She was Tier 4 Child, but then she switched to Tier 1 Dependant. As it says in her passport, the old leave was superseded by the new leave.

She needs a new Tier 4 Child visa. She can only apply in her home country, not in the UK.

You don't say why she (or you) chose to switch her visa from Tier 4 Child to Tier 1 Dependant, but it was pointless and has actually caused this problem.

sah10406 She had visa Tier 4 till 2018 and our family decided to move to the Uk and start business. We got visa Tier 1 and lived in the UK. We had problem with our business and came back home but she stayed in the UK to study. Once after that the officer of border to allowed her across the border with current Tier 4 visa and didn't ask Residence permit. He said you can still use the Tier 4 visa with the stamp as I mentioned above. I was really surprised.
If we will not extend Tier 1 will be able she get the new Tier 4 visa?

That was BFO's mistake. I strongly advise she applies for a new Tier 4 Child visa, because her current situation is putting both her and her school in a compromising position legally.
