Help and suggestions needed for Job Creation

Hi gurus

I got my extension next year and somehow I did mistake in Job Creation.

For Position:1 I got 1 staff for jan-17 to Feb-18 for 14 Months ✔ (Full-Time Staff 135 HRS per Month) -Extension will be on March-18

For Position:2 I got 2 staff for following hrs.
Aug-16 (1 staff) = 95 HRS
Sep16 (2 Staff)= 235.53 HRS ✔
Oct-16 (2 Staff) = 235.53 HRS ✔
Nov-16 (2 Staff) = 235.53 HRS ✔
Dec-16 (2 Staff) = 235.53 HRS ✔
Jan-17 (1 Staff) = 95 HRS
Feb-17 (1 Staff) = 130 HRS ✔
Mar-17 (1 Staff) = 135 HRS ✔
Apr-17 (1 Staff) = 80 HRS
May-17 (1 Staff) = 80 HRS
Jun-17 (1 Staff) = 80 HRS
Jul-17 (1 Staff) = 135 HRS ✔
Aug-17(1 Staff) = 135 HRS ✔
Sep-17 (1 Staff) = 135 HRS ✔
Oct-17 (1 Staff) = 135 HRS ✔
Nov-17 (1 Staff) = 135 HRS ✔
Dec-17 (1 Staff) = 135 HRS ✔
jan-18 (1 Staff) = 135 HRS ✔
Feb-18 (1 Staff) = 135 HRS ✔


there are not continues 12 Months Full-time for the second Position.

I think Continues 12 Months break by 3 Months. But home office website doesn't say Continue 12 Months.

What should I do now?

It is becoming tiresome that almost everyday we have to tell people on this forum to go and read the official Tier 1E guide which mostly answers their questions but I don't think people here care to listen at all

The guide says VERY CLEARLY:

172. A single job need not consist of 12 consecutive months (for example it could exist for 6 months in one year and 6 months t he following year) providing it is the same job ( different jobs that have existed for less than 12 months cannot be combined together to make up a 12 month period ) , and the jobs need not exist at the date of application, provided they have existed for 12 months.

Also it is irrelevant the number of hours worked. For a position/job, you must show you have created at least 52 weeks of full time work !!

I had Confusion for post and pre April. I thought this does not allow in post April.

I know it is easy to read so why ppl use this forum. No more questions.

The only difference is that a position/job must exist for at least 12 months unless you are covered by transitional arrangements (pre April 2014)
However such job/position does not need to exist for 12 consecutive months, no matter if you are pre or post April 2014. For example it can be 12 months over a period of two years

I applied for Entrepreneur Visa on Feb-2014 and then Received Refusal. I appealed the decision and Received visa in March 2015.
So which rules apply for employment? Pre-April or post-April ?

Suggestion needed from Zimba and other Gurus.

Pre - April 2014.

The only criteria is when you applied for first entry into the route. I assume it is still the original application in Feb 2014 that was approved and you did not reapply.
