Hello helper.

My brother and wife came to uk years ago, got stay thru work permit. My sister thru her asylum about 6 years ago. I am failed asylum(zimbabwean) for now 6 years. applied 2002, rejected 2003. Met my husband(British) in 2002, married 2004 church of England. Applied fresh claim 2005 for policitical. I have been advised by solictor to wait for news of zimbabwean cases. Those are over. Solicitor asked HO to send me questionaire. HO just replied in dec 2007 to say my case getting attenttion. This sounds good. But me worried sick, have been to some Zimbabwean Policitical meeting in UK, opposition to Mugabe. Afraid to set foot on that soil. even though my parents and older brother are there. Worried about them too. They are thinking of migrating to New Zealand where other brother has settled happily. What are my chances, really want to stay in England, Me very English. Great grandfather Englishmen. Pioneer have proof.

I take it that you do not qualify for an ancestry visa?

The difficulty is that, having rejected your asylum claim, according to the Home Office there is no reason why you should not just return to Zim and then apply for a spouse visa.

This does sound like a case that may well benefit from the case resolution exercise, which is due to be completed by 2012. It might be worth contacting your MP to try and get some progress. A clean criminal record, employment if permitted, a subsisting marriage, and children, would all be positive factors.
