hi all

wonder if anyone can give some advice or info?

i am a UK resident and my boyfriend is a Malaysian citizen. We initially met here in the UK when he was on a visitor visa. He overstayed for 18 months. He has since returned to Malaysia as we read on these forums that the new rules would be in place come 1 April and it would be better to leave before then. I am going to see him in May and we plan to marry.

Do i have to wait 12 months before i can apply for him to join me as my spouse or can i apply as soon as i return back to the UK?

what are our chances as he was an overstayer?

Also, please can anyone advise when we do apply for his entry visa, do i apply here in the UK or does he have to do it at his end? Do i need to go over to Malaysia again to be interviewed?

I appreciate any help or info and thank you for your time in reading this msg.

What do you mean by "UK resident"? Are you a British/Irish or EU/EEA citizen, an ILR/PR holder, or are you here on a visa?

If you are British national and getting married in Malaysia then you have to apply for his spouse visa from Malaysia. You can access information on IND website and follow the procedure.
