Urgently need help

I am trying to seek some immigration advice here regarding my status and how to change it. I have been on IND website but there are only general questions answered. Considering my situation I decided to email my situation in detail to explain my situation in a better way. Let me brief you about my status and then based on that you can advice me the best to your ability.
I came to this country in May 2001 as student and till to date I am still on student visa. During this period I earned diplomas and degrees from various institution. During my stay here I suffered two heart attacks and recently I have gone through a major heart surgery(11 December 2007) and currently under rehabilitation. Meanwhile I also got married(not English but Islamic marriage) to a British National on 11 March 2006 and still married and we are going to have our first baby due July 2008. I sent my passport for extension last year 4 March 2007 for visa extension as student but till to date which is exactly over 1 year now. I have not received it( I have phoned, faxed and posted letter to enquire about my application status but no explanation apart from" still under consideration"). Now you may have this question that when I got married(Islamic, Mar 2006) to my wife why didn't I register at registration office. The reason is that at that time my wife was in the middle of having divorce from previous
marriage and case was in court.Now she is divorced and available for registration under English Law but I don't have my passport to apply for certificate of approval and then follow the procedure for registering an English marriage.

Now in these circumstances which I have discussed with you, I would like to know what advice you can give to me and is there any category in which I can apply for change of my status to spouse or permanent residence or which ever you think my situation falls in.
I would appreciate if you reply me with confidence and an appropriate advice would be of great help. Many thanks :?

it's strange that you haven't received ur passport back. have you changed ur address in between? It could be that HO has returned ur passport to ur old address.

no I have not changed my address, I have been living at current address for over two years now. I calledd the enquiry office and they said it is still waiting furher instructions. :x No query from them, no letter, nothing..

Koolguy, I think you have been patient enough. I think it is time to contact your MP and get that MP to chase the Home Office.

I think you should apply for new passport from your embassy. It is strange they have not given you your passport back. The worst case is that they have lost it so I think

1. You should get your latest passport
2. APply for COA
3. Get married
4 Apply for LLR

Thanks Jamal, I am also thinking on same line, they have not corresponded with me since their acknowledgement letter of receiving my application over an year ago, so there is something that is wrong somewhere. At least they should inform me that what happen to my passport, don't you think they should have an audit for their prformance.

When you applied for the student extension, was it in time?

Have you been making progress (passing all the exams) in your studies & did you provide evidence?

Did you provide evidence of funds?

Is the college a recognised university or on the DfES/DIUS register?

Is the qualification a recognised UK qualification? (and the earlier ones?)

If it is yes to the above I cannot think what else could be holding it up. Perhaps it is a good idea to get in touch with your MP.

Thanks for your concern. Yes everything was right, I applied in time, my documents were complete, my progress was regular and upto date, my financial statement was very good. The school is recognised and registered with DFES. I mean normally if there is problem with anything they write about it and ask for proofs or any paper work but till to date there is no query on my application, nothing at all. So if their is nothing then why the hell on earth they are keeping my passport. Even if they have lost it then they should at least inform me and I should arrange for another one through embassy. I am spending all my holidays here, I cant go anywhere, life seems stuck. :roll:
