Post by nasiaziz » Mon Nov 27, 2017 3:39 pm

Hi
this is a question on behalf of my friend hes soon applying ilr on 10 years basis could anyone answer the following quesiton?

Point given by police 6 points

Proceed to court
B4 going to court send letter and accept guilty for some reason driving without insurance on bike.
Court make it 7 points plus 350 fine on 5 nov 2014
Fine paid on time and points accepted

Now points is 0 on license but Dvla said it will stay on my license until 4 years means perm entry remove from license on 3 June 2018
ILR application due in january 2018.

Now I m wondering will this affect my ILR application

Some people said I don’t need to be worry coz it will not shown on CRB after 2 years
In my case I m already spent 3 and half years
Plz advise me what to do

It will not impact the ILR at all. Any court conviction which is more than 2 years old at time of application will not be used for refusal.

You'll need to declare it though

HI thanks for your reply
but is this a criminal offence or civil as its clear that with any criminal offence they can refuse your application.

An unserious criminal conviction will be ignored if it has been recorded on your criminal record more than 24 months before the ILR application date.
