Urgent Help Needed For My Spouse/Daughter Visa

Urgent Help Needed For My Spouse/Daughter Visa

Hi All,
I am work permit holder with 5 years validity issued by Home office and permanently employed by the employer. Its been around 4 months since I started my job here in UK.Recently my wife and 5months old daughter applied for dependent visa from India through delhi based VFS office. But to my surprise ECO has refused entry clearance for my wife and daughter citing the following reasons:

I am satisfied that you meet the requirements of paragraph 194 of the immigration rules,except for the following:

-Your husband has provided a copy of his tenancy agreement or evidence to show that he owns the property where you wish to stay. There is no evidence to show that there is sufficient space in this property for you to live without the property being overcrowded. There is no evidence submitted of who lives in the property with your husband and no evidence that you have permission to live there. I am therefore not satisfied that you have adequate accommodation in the UK for you and any dependents.(Paragraph 194(iii) of HC395)

-Your husband has not provided his bank statement. He has not shown evidence of funds to support you or that he is receiving a regular salary payment. This means that I am not satisfied that you will be adequately maintained without recourse to public funds.(Paragraph 194(iv) of HC395)

As per the evidence my wife submitted the following proofs:
-PCOPY of pay slips (last 3 months)
-bank statements(last 3 months) - current account
-letter from employer - original
-marriage certificate - original
-PCOPY of my passport
-PCOPY of my work permit
-PCOPY of National Insurance card
-My savings proofs (LIC etc) in India
-birth certificate of daughter
-PCOPY of My Visa pages


I am unable to understand what kind of proof ECO wants which can show that the place I am going to stay with my wife and daughter have enough space for them...? do i need to take some kind of certification from local council body..?
Please not that at the time of applying, I was staying in a shared accommodation but recently shifted to a seperate 1-BR independent flat.. The bank statement and salary slips contain the previous address not the current one.

Also at the time of applying the visa, i was having only 3 months salary slips since i started my job only 3 months back same is true with the bank statements. What is the defination of enough funds ? is there any criteria about the minimum amount one should have in his account to fulfill/meet the criteria and to show that sponsored is enough capable to support financially his family without recourse to public fund.

Do i need to submit Sponsorship Undertaking form Form SU07/01 ?

I am totally confused now and dont know how to proceed ahead, please advise me so that i can come out of this sticky situation

hi neeraj..

to show that there will be enough space for ur wife and baby u need to get a certificate/report from the local council. contact the council and tell them that u a sponsoring someone and u need a report showing there is adequate space. sum councils do this for free and sum do charge. if the property is rented then what u can do is get a letter from ur landlord stating he has no problem with ur wife to move into the accomodation and that u are the only perosn who is living at the address.

as for ur bankstatements, go to the bank change ur address and then request ur last 3 or how many statements u want, to be sent to ur current address. this way ur statements should show the new address ur living in now

hmm i dont no y there are complaining about the financial side becuz u have provided them with payslips, employment letter, etc..

may b sum1 else can advise u on that.. :)

Thanks for quick response and help.

I am still confused about the financial status :cry: I mean how to show that I am anough capable to support my wife and 5 month old daughter.

3- Is it necessary to produce atleast 6 months salary slips and bank statments...in my case i just completed my 4 months so at max i can produce 4 months salary slip or i will have to wait till i complete my 6 months at job?

4-Do i need to submit Sponsorship Undertaking form Form SU07/01 ? Is it required as my wife or me is not applying for settlement visa.

5- Can I show my and my wife's savings in India to make my case stronger?

I would appreciate any help in this regard.
