Tier 2 Dependent Visa to ILR

Post by zsiddiqu » Sat Dec 09, 2017 1:45 am

Hi,

=> I am on Tier 2 Visa. My visa Start Date is 17th july, 2014 and Visa expiry date is 31st August, 2019.
I arrived in the UK on 1st August.

1) will I be eligible for ILR on 17th July, 2019 or 1st of August, 2019?

=> My wife got the Tier 2 Dependent visa. Her visa Start date (17th july, 2014) and visa expiry date (31st August, 2019) is same as my one. However she came to Uk on a later date i.e. 15th October, 2014.

2) I understood that In order to be eligible for ILR, the residency requirement for Tier 2 dependent has to be 5 years. in that case will she be eligible for ILR on the same date as Me i.e. 17th July, 2019 or she has to fulfill the 5 year stay i.e. until 15th October, 2019?

3)for the later case, does she needs to apply for another Tier 2 Dependent visa on 31st August, 2019 (current visa expiry date) to complete the 5 year of stay or she needs to apply for dependent of a ILR visa?

=> My daughter born in the UK on 23rd March, 2015. Her visa start date is 7th September, 2015 and Visa expiry Date is 31st August, 2019.

4) will she be eligible to apply for ILR as the same date as mine i.e. 17th July, 2019? or she has to apply for Tier 2 dependent visa again with her mother? in that case, when she will be eligible to apply for ILR?

4) when she will be eligible to apply for Citizenship when both my wife and I will get the ILR?

Thanks in advance for your response.

Regards

Note that Immigration rules and guildances may change prior to 2019.

1) I think that you may apply for ILR no sooner than 28 days prior to 17 July 2019. Date of visa issue relevant.

2) I think that your wife may apply for ILR no sooner than 28 days prior to 15 Oct 2019. Date of initial entry relevant.

3) Possibly she requires an extension as a PBS partner. Vary it to ILR, if her application is undecided when she qualifies for ILR.

4) UK born daughter is entitled to register when either parent has ILR.

Hi,

Thanks for your reply.

For 1) & 2) you said ' i think', isn't it a confirmed/valid statement?

For 2), Her visa will expire on 31st of August 2019 and 28 days prior to 15th October is 17th September. So there is a gap in between 31st August and 17th September. Does she needs to apply for tier 2 dependent for that 17 days?

response to 3) is not clear. would appreciate if you can elaborate it further? Thanks
