demurrage charges to the customer

demurrage charges to the customer

Hi

We have recently immigrated to Europe. The container with our goods has apparently been held up in Germany because of a train accident. For this delay, however, the removal company will be charging us, the client.

Now, our removal contract does say that it excludes demurrage, but doesn't explicitly say that we will be liable for all demurrage. As far as I understand rail law (which is almost nothing), the moving company CAN claim demurrage , but not from the client - from the railway.

This is also the point made in wikipedia (http://en.wikipedia.org/wiki/Demurrage), but I know that I can't easily quote that.

We're also being charged for the 'rent' of the container, and then another EUR100-odd for the 'return of container.' - this sounds like a rip-off.

Does anyone have experience of this, of know of who I can contact (as long as the fee is not greater than the demurrage costs :-)
