I am a 19 year old Malawian boy. I came to the UK in June 2004 with my mother who was taking a job in the NHS. My visa is valid until 2010. My mother has just married a UK born British man. I am still dependant on my mother and I am due to leave college in 3 months. What will my status be when I leave college? Will I qualify for a normal student's loan if I go to Uni? Can I work? Can my visa status be changed/improved because my step-father is British? Please help.

What visa are you currently on? Is it a dependent visa based on your mother's work permit? Or is your mother now on (or going to apply for) a spouse visa? When do you apply for ILR?

You won't qualify for a student's loan as you need to have ILR for that. You will also be charged International fees if you decide to go to university, so you might want to wait until you obtain ILR.

Thanks for info on uni fee status.
I currently hold a dependant's visa, valid till 2010, when I should apply for LTR. My mother's new visa is a marriage/settlement visa, issued late last year, thus within the first year of validity. How does this affect me and my rights? Please help.

Is your visa based on your mother's work permit or her marriage? When your mother changed her visa, why didn't you?

You need to obtain ILR for both "home fees" and student loans.
