Getting divorce whats the situation?

Hi everyone, This is the situation i'm into,i'm not asking on behalf of anyone else so any tip is much appreciated

10/2002 Came to UK with student visa.
7/2004 Got married to a EU citizen(swidish) in London.
7/2004 went to the EU country origin of my wife and stayed there for 9 month then back to my counrty of origin to get entry clearance and got back in UK.
5/2005 Entry clearance was valid for 1 year then applied for spouse visa.
Spouse visa valid till 26 june 2008.

11th may 2006 criminal offence(conviction charge) theft/going equipped. The court imposed a community order for 50 hours and £60 charge which i did it.

Just wondering if i can stay in uk if i get divorce or i have to go back to my country,I've heard if you marry an EU national and stay in uk for 3 years you can stay is that true? please advise. Many thanks

What was your entry clearance visa in 2005? Did you apply for a spouse visa or an EEA family permit to enter the UK? How long had your wife been living in the UK?

Are you now divorced?

Entry clearance was an EEA family permit visa to join spouse which was valid for one year then we re-newed my visa and i was given 2 year right of residency as a family member of an EEA national which will be expire in 2 month. My wife been living in UK for about 5 years and she got a residency card. we are not divorce yet but i want to get divorce due to some family issues between us. she is not going to coaperate to renew my visa anyway i'm just wondering what to do realy ! please advise thanks
