I'm worried I broke the 6 months rule and I want to visit the UK again

Post by katkat » Sun Apr 08, 2018 11:11 am

Hello guys, I would really appreciate your help on this matter.

To summarise my situation, I used to think that the 180 days stay duration stated in my visa is valid every time I enter the UK. This is specifically the wording used on the official website and relised only later that it may be 6 months total in one year. I honestly still not sure exactly how it is calculated because there are many conflicting things online and no enough official information.

So, let's say I entered on 01/07 and left 28/09 (88 days) and then entered again 05/010 and left 17/03 (165 days). Did I break the rules? I didn't enter the UK since then but I really want to go to my friend's wedding and I'm afraid of my visa getting rejected. I don't need a Shengen visa and I've travelled to many European countries since then and I already have an American tourist visa but I'm afraid if I applied to a UK visa and got rejected, since they share information, this may effect me entering Europe and the US. Also I know this may sound bad but it is sadly true, do you think they will be more laxed about it since I'm from a country where rarely any one stay there illegally, I have a good income and already graduated from a top school in the UK. So the chances of me using my UK tourist visa to work illegally is very unlikely.

I would really appreciate your help, and your personal advice, would you apply to another visa or not risk it. Also who should I ask, a lawyer or the embassy? Bear in mind that there is talks that they may drop visa restrictions for citizens from my country so I was thinking, I should wait till then to enter the UK again.

Another question is, if I end up applying, should I just apply normally and not mention any thing maybe they won't even focus that much, or is it better to explain my situation in a statement.

Thank you sooo much already.

How long did you request to stay in your visitor visa applications? Did you exceed the requested time during either of your visits?

Thank you for getting back. I've requested 2 years and I've never exceeded it and left way before it expired.

I'm not referring to the length of the visa, but how long she stated she would stay in the UK on each visit. I assumed she was asked this by the IO at UK Border Control on entering.

I don't remember as it was 2 years ago but the first time I entered after getting the visa was only 5 days, and after that I don't remember them asking me how long I'm staying (only why I'm visiting) and even if they did I don't think they were recording or any thing.

They would be able to work out the length of stay from the entry and exit dates and compare that with how long it was actually stated on the application form the applicant was going to stay in the UK.

Normally, although you may be granted a 6 months Visa, it is what is stated on the application by the applicant the length of duration they are going to stay in the UK for that UKVI look at, any length stayed after that stated duration, they may see it as deception or you may be trying to settle in the UK.
These are my 'views' and 'opinions'.
If in doubt always seek professional advice, or at least do a search for the relevant information. :P

If i make any mistakes, You are more than welcome to correct me.
