requesting passport back

hi me and my EEA wife will applying for pr under EEA law next week and shes planing for trip to see her mum in July if we wrote note the home office she could get her passport back by then and they will carry on with application processing or they will draw it??? Thanks for any advice

If someone requests return of their passport and leaves the UK, any application is regarded as withdrawn

Under UK law that is correct, but it does not apply for applications under European law. You can apply for EEA2 and then travel without affecting the application. The web site no longer tells you this (it used to), but you will find a number of reports from people that have done exactly this.

i got the 5 years all ready expire soon im saying my franch wife need her passport by july she need to travel im sending our application tomorrow to home office to apply for permanent residence if i write note with application so they will send it back and the wont draw the application? thanks
