I hope someone could help.
I'm a British Citizen and my husband is a Nepalese Citizen. He arrived in the UK on a spouse visa on 10/06/2013. He currently has FLR. His Biometric residence permit expires on 15/08/2018.
1.) When is the earliest date he can apply for ILR? Is it once he's completed his 5 years? If so can he apply 28 days before (14/05/18) and any time up til his BRP expires?
2.) What are the rules regarding time spent outside of the UK? e.g. is it so many days per year and the year started from the date of arrival. No more than 180 per year from 10/06/2013 - 9/10/14 and so on?
3.) Could you confirm if I've missed any documents that are required:
Set(M) application form
Husband's passport & BRP card
Husband's passport photo's x 2 with name written on the back
My passport photo x 1 name on the back
Marriage certificate
Life in the UK pass certificate
English language test (He passed the English Language test a couple of years ago and submitted it for his FLR application, can he use the same one or does he have to take it again?)
6 months bank statements in husband's name
6 months bank statements in my name
6 months saving account statements joint
6 months wage slips - husband's
6 months wage slips - mine
Employment letter - husband's
Employment letter - mine
Tenancy agreement from landlord
Letter from my mum and dad confirming the dates we stayed with them before moving out
Proof of address dating back over the last 5 years (one letter dated each year in each of our names)
Thank you in advance. I'm so paranoid about the application. I know he will be able to provide more evidence than required but just want to make sure we have everything and apply on the correct date.
