MARRIAGE IN SPAIN AND JOB OFFER - SOUTHAFRICAN

Hello everyone :)
I am looking for an advice as the situation seems to be complicated.
So....I am Polish so I don't have any problem but my boyfriend is South African, as his visa for 'working holiday' expired he is now in his country and I am still in UK until I finish my University now in May.
The problem is that t we do not want to stay in UK and go for fiancé visa.
We want to move to Spain where my parents are settled for many years.
How he can join me in Spain with fiancé visa (if exists) when I will be not 'settled' in Spain myself ? I mean I am not going to work straight away But....
Also my boyfriend has 120% guaranteed job as a forklift driver in the big warehouse ( that is where my dad is working,is the job good enough? i mean is there a reasoning that it must be a job which sb from EU cant cant be employed?) and bosses will supply any documents needed to support his application.

What should he do?
1. First apply for working visa and then organize work permit when he is in Spain?
Or
2. Wait until the bosses will organize him a work permit and only then apply for visa to Spain?
3. Or just arrive on tourist visa and then get a job and apply for work permit
4. Or..... arrive to Spain on tourist visa or fiancé visa marry me and the n start work ?


Ahhhhh, it's so complicated, but at least we are not alone here :)

I doubt he can get a work permit as a forklift driver, so you shouldn't go for a work permit. Your option would be based on marriage. I do not know what it is called in Spanish, but you need to apply under Directive 2004/ec/38 (do a search on this message board), which allows EU nationals to move and reside freely in other EU countries with their non-EU partners. I think you can contact the Spanish embassy in South Africa for details on this.

We been together just less than 1,5 year...not 2 years so too difficult to go for unmarried parter visa.

Ok, so forgetting the fact of getting work permit or working visa due to job position which is not so much qualified one....

On what visa my South African Boyfriend can come to Spain to marry, and after it what he should apply for to be allowed to work in Spain ?

If you are married, then you spouse will have rights equivalent to yours while in Spain with you.

Note that it does not matter what type of job or how well paid it is in Spain. It only matters that you are working.

Hi. I am south african and just got married to my spanish partner. Seemed to be the only way to do it. I just came as a visitor (3 months) and then overstayed until I got married. Hope this helps

I have applied for my Identity card and that takes a while but according to most posts I am "legal" already just because it is documented that Im married. I myself is actually trying to find out exactly what I can do once I received my identity card as me and my wife are trying to move to London but thats a story for another post I suppose.

So is it basicly fine to arrive to Spain on visitor 3 mths visa and marry within that time??

I thought u suposed to come different visa for exmple fiance visa

And one more question, I dont speak Spainish and he also doesnt, where should we marry ? I beleive we should make it in English :)

Hi

Yes he can come on his 3 month visitor visa and you dont have to marry within that time (dont think that would be possible) but just have to submit all your paperwork indicating that you do want to get married. We got married in "registro civil" which is basically infront of the judge but I do speak a bit of spanish and needed to make an interview for them to see that we actually are a couple. I know there is a english speaking community and there should be a way to do it in English but I live in a small town so didnt have that option. Just make sure your boyfriend get all his paperwork in SA (especially letter that he is single and birth certificate which has to be translated and legalised). Both of those papers took me 2 months to get so he should try get it as soon as possible but the single paper is only valid for 6 months so just keep that in mind. I am just letting you know of things that went wrong when I tried to apply because I nearly had to go back to SA for another 3 months because of my papers and their expiration dates. Luckily the SA embassy in Madrid was a lot of help.

Do you think it is possible to marry faster than that 3 months ? The thing is I have my family there , maybe they can submit the documents for us and I can get there before he gets there ? So when he arrives to Spain already some apaerwork can be done to the point where he is interviewed ( unless they interview you at very begining of that marriage process )

We r going to stop in Madrid what should be easier. So u think documents shall be in English or Spanish if we will have to stick with English language during the interview and marriage itself.

Hi again,
I read that it is a possible to apply for NIE from own country but s it possible to apply for NIE from South Africa or he has to wait until after marriage when he rights become equal to mine (EU)?

any tips what other translated documents he may need ?
