married to Polish

someone I know asked me for advise, he is married to a Polish girl and i am wondering what can he do? it's a bit risky for him to go to the town hall and registrar as he might be detained? a solicitor ? I am not sure but what;s the best course of the action, he's from Algeria and he doesn't want to go back at all there, he's illegal here, came illegal too, can anyone hlpe plz,thanks

When did they marry? How did he marry without a certificate of approval (CoA) from the Home Office? Is this a legal or religious marriage?

Just wondering how it can be classed as an Islamic Wedding ceremony if one of the parties doesnt follow the religion - in terms of 'acceptance of vows' etc?

the woman doesnt have to be a muslim to get married to a muslim guy . as long as shes either christian or a jew (believes in god that is ) they can get married in a muslim ceremony.

I've always thought that a non-muslim had to convert to being a muslim before one can get married. (to a muslim, ofcourse! :wink: )

Thats my understand ing - and I think that may be correct. Thats why so many women convert - just to get married. Then regret it very soon after!!!

They would have stood a better chance if they were married in the Church of England, as in that case the husband would have got an automatic right to be with his EEA wife.

Religious marriage
A religious marriage certificate cannot be accepted on its own except as evidence of a common law relationship.
Where a religious marriage has taken place in the UK the application should be refused on the basis that we do not accept that the couple are legally married, unless it is clear that the non-EEA national would qualify as a common-law partner.

Under no circumstances should a person be granted a residence card on the basis of a durable relationship if s/he is not lawfully resident in the UK at the time that the application is made.
Although a non-EEA national can be considered on the basis of Regulation 8 if s/he has provided proof that s/he is in a durable relationship we have discretion with regard to the issue of a residence card. We should not seek to exercise discretion in his/her favour in instances where the non-EEA national is not lawfully resident in the UK.

it's broad...well, how about me? I am an asylum seeker with no status yet, my wife has no status and we're married, we're both muslims, my marriage was with imams back home ( without me but witth both parents) so any idea how it works then

abey bhosri kay! ye tu bata tera status kia hai UK mein....phir tujhe koi advice kar sakta hai......bas aa kar paad dia....kay meri BV polish hai...gando teri shaadi registered marriage nahi hai....iss liye tera kuch nahi ho sakta. pheley register karwa apni shaadi....lund!...Home office ye pooche ga ke tu ne polish randi ko kitne mein khareeda....

dear brother! first tell as whats ur status in UK ....then somebody will be able to advice you.....it is not enough that your wife is polish....actually you got to register your marriage first ....otherwise you can get permanent stay in UK. Home offic wont accept this type of marrige ..dear!

A civil marriage, with legal paperwork and you will need a CoA - certificate of approval before you can do that. As an illegal you have not got a hope! UKBA is just not going to entertain anything from the individual as they have no right to be in the UK. Even as a non-EEA spouse you still have to have a valid passport. Does he even have that?

Like many others the belief that getting married solves immigration problems is a misnomer.
