messed up status

i need same advice here very fast.
I applied for leave to remain as student in 2005 and posted my application and i was 15 days late. It was send back because i head not singed the form and forgot to put in the postal order. I used my schools address as the contact address, when the college received the documents i was suppose to return it within 28 days but that never happened same one felt it was not neccessary they kept the documents for 5 mouths never told me my documents was sitting there. I only found out about this when i called the home office that is when they informed me they head send the documents to my college. When i went there to collect the documents i was shocked and when i took the matter up with the admin they did not want to hear anything to do with me. I returned the documents back to the home office explained the situation why my documents where late. They took almost a year to get back to me by then i head to write to them about my case 2007. In there reply they mentioned i head overstayed my visa, needed an enterance clearance and i head not demonstrated i head registered to continue with my studies.
So i should report to an immigration centre reporting every month untill further notices from the home office i have been doing this for 6 month. Now i have not stopped going to college got my degree and now finishing ACCA i have all my attence and progress reports . My question is can i apply for the HSMP or can i reply for the student visa or any alternative means of correcting my status

Sorry to be harsh, harsh.

But unfortunately your status is currently that of an overstayer. The Home Office are not listening to any sob stories this year so you might want to take advantage of the current concession and return home before 1 October 2008 for an entry clearance application as a student.

If you decide to do this make sure before leaving that you get the necessary documentation from your college (I asssume that you have changed to a new one).

Check that your college is a registered one (since they took you as an overstayer) and that they can issue you with a sponsorship certificate. Also take all your evidence of attendance at college, exams passed etc.

You might also want to explain to the Home Office why you decided to overstay after being informed that you were an overstayer. And if you are signing on, bear in mind that you could be removed at any time and that you would then be excluded from returning to the UK for 10 years.

But no doubt you have more information to help clarify your situation..

The problem is that they are holding my pass port so what do i do then write to them or what.

If you decide to go home, you need to take evidence of your ticket and flight schedule next time you sign on. You can request the return of any documents you need (excluding the passport). Give them at least 15 days notice before you intend to travel.

They will arrange for your passport to be available when you arrive at the airport.
