Post by dreadled » Fri May 09, 2008 8:03 am

Hi i need help. i live in PH and currently in US for almost 2 yrs now and i have J1 visa that will expire this december and i ask my girlfriend(UScitiezen) to get married this june, happily she agreed=) and i have a son left in PH. im a single dad and not married in PH.

my question is Should i go back to PH before my visa expire even were already married here in US. or go back to PH wait for my spouse visa then jump back here US?

if i dont have to, whats the next step to get my son as soon as possible?

how long should it take to get his(son) visa?

According to these links, you might be able to apply for an Adjustment of Status (AOS):

So, if your J1 visa requires you to return home, then you cannot apply within the USA and will have to return home....for how long I am not sure.
